VESSEL RENTAL CONSENT, SAFETY & LIABILITY AGREEMENT / 船只租赁、安全与责任同意书

SECURITY DEPOSIT / 押金

Private charters carry a refundable security deposit, paid with the booking and returned 3 to 5 days after the trip if there is no damage, loss or abnormal cleaning: Promark Houseboat RM800 · Promark I & III Houseboat RM800 · Promark II Yacht RM800 · Promark Oceanbook RM2,000 · Promark Ange Etoile RM3,000.

私人包船须付可退还押金，随订单一起支付；如无损坏、遗失或额外清洁，行程后 3 至 5 天退还。

IMPORTANT – PROMARK ANGE ETOILE: RED WINE IS STRICTLY NOT PERMITTED ON BOARD.

特别规定 – PROMARK ANGE ETOILE：船上严禁携带或饮用红酒。

1. ACKNOWLEDGEMENT OF RISK & SAFETY BRIEFING / 1. 风险确认及安全简报

I understand that boating, yacht, houseboat, sailing and other marine activities involve inherent risks, including vessel movement, waves, changing weather and sea conditions, slipping, falling, equipment malfunction and unexpected accidents.

本人了解参与船屋、游艇、帆船及其他海上活动存在一定风险，包括船只晃动、海浪、天气及海况变化、滑倒、跌倒、设备故障或其他突发事故。

I confirm that I have received or will receive a safety briefing from Promark crew before departure, including emergency procedures, prohibited activities, and the location of life jackets and safety equipment.

本人确认在出航前已接受或将接受 Promark 船员提供的安全简报，包括紧急应对方式、船上禁止事项，以及救生衣和安全设备的位置。

I agree to comply with all reasonable safety instructions given by the Captain and crew, including any instruction to wear a life jacket.

本人同意遵守船长及船员给予的一切合理安全指示，包括在被要求时穿戴救生衣。

2. PASSENGER CAPACITY & BOOKING CONFIRMATION / 2. 登船人数及预订确认

The customer confirms that the total number of passengers attending the trip shall not exceed the number declared and confirmed with Promark Customer Service at the time of booking, and shall in all cases remain within the permitted passenger capacity of the booked vessel.

客户确认，当天实际登船人数不得超过预订时向 Promark 客服申报及确认的人数，并且任何情况下均不得超过该船只所允许的安全载客人数。

If additional or unregistered passengers arrive on the day of departure, they may only board if the vessel’s permitted passenger capacity is not exceeded and Promark has approved the additional passenger(s).

如出航当天临时增加未经预订的乘客，只有在没有超过该船安全载客人数，并获得 Promark 同意的情况下，额外乘客才可登船。

UNDER NO CIRCUMSTANCES WILL PROMARK ALLOW THE VESSEL TO EXCEED ITS PERMITTED PASSENGER

CAPACITY.

任何情况下，Promark 均不会允许船只超出规定的安全载客人数。

If the number of passengers exceeds the permitted capacity, Promark and/or the Captain has the right to refuse boarding to the additional passenger(s). No request, insistence, payment or willingness to accept risk will override this safety requirement.

如实际人数超过船只允许人数，Promark 及/或当值船长有权拒绝超出人数的乘客登船。即使客户提出要求、坚持、愿意额外付款或愿意自行承担风险，公司亦一律不予通融。

3. HEALTH DECLARATION / 3. 健康声明

I confirm that I am physically fit to participate. I am responsible for informing Promark crew before boarding of any medical condition, physical limitation, allergy or other health condition that may affect my ability to participate safely.

本人确认身体状况适合参加本次活动。如本人有任何可能影响安全参与活动的健康问题、身体限制、过敏或其他身体状况，本人有责任在登船前主动告知 Promark 工作人员。

If I feel unwell during the trip, I will immediately inform the Captain or crew.

如在行程中感到身体不适，本人将立即通知船长或船员。

4. CAPTAIN’S FINAL SAFETY AUTHORITY / 4. 船长最终安全决定权

The customer understands and agrees that the Captain has final authority on all safety-related matters, including departure, route, speed, anchoring, swimming or water activities, stopping an activity, changing route, shortening a trip, delaying departure or returning to the marina when reasonably required by weather, sea conditions, technical condition or passenger safety.

客户了解并同意，所有涉及安全的事项均由当值船长作最终决定，包括是否出航、航线、航速、停泊、游泳或水上活动、停止活动、更改航线、缩短行程、延迟出航或因天气、海况、技术状况或乘客安全而提前返航。

Customers must not pressure or instruct the Captain to proceed with an action that the Captain considers unsafe.

如船长认为某项安排存在安全风险，客户不得要求、施压或强迫船长继续执行。

5. SAFETY RULES & CUSTOMER CONDUCT / 5. 安全规定及客户行为

• Follow all instructions given by the Captain and crew.

遵守船长及船员给予的一切指示。

• Observe all safety and emergency procedures and all permitted or prohibited areas.

遵守所有安全及紧急程序，以及船上允许或禁止进入的区域。

• Use onboard facilities and equipment responsibly.

正确并谨慎使用船上设施及设备。

• Do not interfere with the helm, engines, anchor system, navigation equipment or safety equipment without permission.

未经允许不得触碰或操作驾驶台、引擎、锚机、导航设备或安全设备。

• Avoid any action that may endanger yourself, other passengers, crew or the vessel.

不得进行任何可能危害自己、其他乘客、船员或船只安全的行为。

6. CHILDREN & MINOR SUPERVISION / 6. 儿童及未成年人监管

Children and minors must remain under the supervision of their parent, guardian or responsible adult at all times. Promark crew are responsible for vessel operations and safety procedures and are not appointed as babysitters or personal child supervisors.

儿童及未成年人必须全程由其父母、监护人或负责的成年人照顾及监管。Promark 船员主要负责船只操作及安全程序，并不承担私人看护儿童的责任。

7. PERSONAL BELONGINGS / 7. 个人物品

Passengers are responsible for their own personal belongings at all times. To the extent permitted by applicable law, Promark is not responsible for phones, cameras, jewellery, bags or other valuables that are dropped into the sea, exposed to water, damaged, misplaced or lost.

所有乘客必须自行保管个人物品。在适用法律允许的范围内，对于手机、相机、首饰、包包或其他贵重物品因掉入海中、进水、损坏、遗失或放错位置所造成的损失，Promark 不承担相关责任。

8. DAMAGE, LOSS & SECURITY DEPOSIT / 8. 财产损坏、遗失及押金

I understand that I am responsible for damage or loss to the vessel, furniture, equipment, fittings or other property caused by myself or members of my group through misuse, negligence, violation of instructions or intentional acts.

本人了解，如因本人或同行人员的不当使用、疏忽、不遵守工作人员指示或故意行为，造成船只、家具、设施、设备或其他财产损坏或遗失，本人需承担相关责任。

Where applicable, reasonable repair, replacement or additional cleaning costs may be deducted from the security deposit. If the total reasonable cost exceeds the security deposit, the customer may be required to pay the balance.

如适用，合理的维修、更换或额外清洁费用可从押金中扣除。若实际合理费用超过押金金额，客户可能需要承担相关差额。

If no damage, loss, abnormal cleaning or other charge applies after inspection, the security deposit will be returned in accordance with Promark’s applicable deposit procedure.

如检查后没有发现损坏、遗失、异常清洁或其他应付费用，押金将根据 Promark 当时适用的押金流程退还。

9. FOOD, DRINKS & CLEANLINESS / 9. 餐饮及清洁规定

Customers must use reasonable care when consuming food or beverages on board and must comply with any vessel-specific restrictions communicated by Promark.

客户在船上享用食物及饮料时必须保持合理谨慎，并遵守 Promark 针对不同船型所规定的特别限制。

PROMARK ANGE ETOILE: RED WINE IS STRICTLY PROHIBITED. If prohibited items or customer conduct cause staining, damage or abnormal cleaning, reasonable professional cleaning, repair or replacement costs may be charged or

deducted from the security deposit. 如因客户违规造成染色或额外清洁，公司有权收取合理的清洁并从押金中扣除。

10. MAIN BOOKER / LEAD GUEST RESPONSIBILITY / 10. 主要预订人责任

The Main Booker / Lead Guest agrees to ensure that all members of the group are informed of the key safety rules, prohibited conduct, vessel-specific restrictions and passenger-capacity requirements before departure.

主要预订人同意在出航前向所有同行人员说明主要安全规定、禁止行为、船型特别限制及载客人数规定。

11. PAYMENT, REFUND & RESCHEDULING POLICY / 11. 付款、退款及改期规定

• Full payment is required to confirm the booking.

预订须完成全额付款方可确认。

• Payments made are non-refundable, subject to applicable law.

一经付款原则上不予退款，但须以适用法律规定为准。

• A maximum of three (3) reschedules is allowed, subject to availability and advance notice.

每个预订最多允许三（3）次改期，须提前通知并视船期安排而定。

• No refund will be provided for late arrival, early departure or reduced trip time caused by the customer.

因客户迟到、提前离场或其他客户自身原因导致行程时间缩短，不予退款。

• No refund will be provided where a participant refuses to comply with reasonable safety instructions.

如乘客拒绝遵守合理的安全指示，不予退款。

• If weather, sea conditions or technical issues make the trip unsafe, Promark may postpone or reschedule the trip to another available date.

如因天气、海况或技术问题导致无法安全出航，Promark 有权将行程延期或更改至其他可用日期。

• Where a trip is rescheduled due to weather or technical issues, payment will be carried forward to the rescheduled trip, subject to applicable law.

因天气或技术问题改期的款项将保留至新的行程日期，并须以适用法律规定为准。

• Promark may stop or terminate an activity where a participant creates a safety risk, seriously disrupts the trip or repeatedly refuses to follow the Captain’s instructions.

如客户行为造成安全隐患、严重影响行程或多次拒绝遵守船长指示，Promark 有权立即停止相关活动或终止行程。

• Illegal drugs and illegal substances are strictly prohibited. Suspected illegal activity may be reported to the relevant authorities.

严禁任何违法药物或违法物品。如发现涉嫌违法行为，公司可向相关执法单位举报。

12. INSURANCE & LIABILITY / 12. 保险及责任说明

I understand that marine activities involve risks that cannot be completely eliminated. Any applicable insurance coverage is subject to the terms, conditions, exclusions and limits of the relevant insurance policy.

本人了解任何海上活动均存在无法完全消除的风险。任何适用的保险保障均须视相关保险保单的条款、条件、免责事项及保障范围而定。

I agree to take reasonable care for my own safety and to comply with all safety instructions.

本人同意对自身安全承担合理责任，并遵守所有安全指示。

To the extent permitted by Malaysian law, Promark shall not be responsible for injury, illness, damage or loss resulting from a participant’s own negligence, misconduct, failure to follow safety instructions or other actions beyond Promark’s reasonable control.

在马来西亚法律允许的范围内，如因参与者自身疏忽、不当行为、不遵守安全指示或 Promark 合理控制范围以外的因素所造成的受伤、身体不适、财产损坏或其他损失，Promark 不承担相关责任。

Nothing in this Agreement is intended to exclude or limit liability that cannot legally be excluded or limited under Malaysian law.

本协议中的任何条款均无意排除或限制依据马来西亚法律不得被排除或限制的责任。

13. PHOTOGRAPHY & MEDIA CONSENT / 13. 摄影及媒体授权

Promark may take photographs and/or videos during the activity for social media, website, advertising and promotional use.

Promark 可能在活动期间进行拍照或录像，并用于社交媒体、官方网站、广告或其他宣传用途。

14. FINAL ACKNOWLEDGEMENT BEFORE DEPARTURE / 14. 出航前最终确认

1. I have read and understood all terms and conditions stated in this Agreement.

本人已经阅读并清楚了解本同意书所列出的所有条款及规定。

2. I understand the safety rules, passenger-capacity requirements, payment and rescheduling policy, security deposit, damage responsibility, prohibited conduct and vessel-specific rules.

本人已了解相关安全规定、船只载客人数限制、付款及改期政策、押金规定、财产损坏赔偿责任、禁止行为及船型特别规定。

3. I have been given sufficient and reasonable time before departure to read and understand this Agreement.

Promark 已在出航前给予本人充足及合理的时间阅读及了解本同意书内容。

4. I confirm that I have not been rushed, pressured or asked to sign this Agreement without having a proper opportunity to read it.

本人确认 Promark 并没有催促、强迫或要求本人在没有充分阅读的情况下匆忙签署本同意书。

5. I have had the opportunity to ask Promark staff questions regarding any part of this Agreement that I do not understand.

如有任何不清楚的条款，本人在签署前已有机会向 Promark 工作人员提出询问。

6. Any questions or concerns raised by me before departure have been explained to my reasonable satisfaction.

本人在出航前所提出的相关疑问，已获得合理解释。

7. I understand that this Agreement must be read, understood and signed before the vessel departs.

本人清楚了解，必须在船只出航前完成阅读、确认及签署本同意书，方可出航。

8. By signing below, I confirm my acceptance of these terms and agree to comply with all reasonable safety instructions from Promark and the Captain during the trip.

本人签名即表示已确认并接受本同意书所列出的相关条款，并同意在整个行程中遵守 Promark 及当值船长给予的合理安全指示。

CUSTOMER FINAL CONFIRMATION / 客户最终确认

• I confirm that I have been given sufficient time to read and understand this Agreement before signing.

• 本人确认在签署前已获得充足时间阅读及了解本同意书。

• I confirm that the passenger number declared to Promark is accurate and does not exceed the vessel’s permitted capacity.

• 本人确认向 Promark 申报的登船人数正确，并没有超过该船规定的安全载客人数。

15. GOVERNING LAW / 15. 适用法律

This Agreement shall be governed by the laws of Malaysia. Any dispute arising from this Agreement shall be dealt with by the appropriate court or authority having jurisdiction in Malaysia.

本同意书受马来西亚法律管辖。任何因本同意书产生的争议，将根据马来西亚法律由具有适当管辖权的法院或相关机构处理。
